WAIVER OF LIABILITY

RELEASE, WAIVER AND INDEMNITY AGREEMENT AND AGREEMENT TO ASSUME RISK OF POTENTIALLY HAZARDOUS ACTIVITY: I hereby acknowledge this release from liability for accidental injury or illness which I may incur as a result of participating in any physical activity. I hereby assume all risks connected therewith and consent to participate in this program. I agree to disclose my physical limitations, disabilities, ailments, or impairments which may affect my ability to participate in this program.

For good and valuable consideration (value), the receipt and sufficiency of which is hereby conclusively acknowledged, including but not limited to being permitted to enter an event venue holding a performance or competition sanctioned by Aerial Arts Society or any other location (the “Event Venue”) for any purpose, including but not limited to observation, use of facilities or equipment, or participation in any way—such as training, performing, volunteering, judging, and/or competing in pole dance, lyra, silks, or any other apparatus provided by or to the collective (collectively, “the Aerial Arts Society” which are engaged in potentially hazardous activities), I, for myself, my heirs, personal representatives, or assigns, do hereby RELEASE, WAIVE, DISCHARGE, and COVENANT NOT TO SUE Aerial Arts Society Inc, their respective founders, board members, officers, directors, instructors, employees, agents, affiliates, collaborators, volunteers, and any other representatives (hereinafter referred to as "Hosts") including non hosts, from liability for any and all claims, including negligence of the Hosts resulting in personal injury, accidents, illnesses (including death), and property loss arising from, but not limited to, participation in the event. In further consideration of being permitted to enter the Event Venue for any purpose, including but not limited to observation, use of facilities or equipment, or participation in any way, including in the Aerial Arts, the undersigned hereby agrees to the following: Participation in the Event carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. The specific risks vary from one activity to another but include the following: Minor injuries such as scratches, bruises, and sprains Major injuries such as eye injury or loss of sight, serious cuts, joint, back, or spine injuries, broken bones, heart attacks, and concussions Catastrophic injuries including paralysis and death I have read the previous paragraphs, and I know, understand, and appreciate these and other risks that are inherent in the Event. I hereby assert that my participation is voluntary and that I knowingly assume all such risks. THE UNDERSIGNED HAS OBTAINED OR WILL OBTAIN AN APPROPRIATE MEDICAL CHECKUP, BEFORE COMMENCING ANY AERIAL ARTS TRAINING, WITH A PHYSICIAN TO VERIFY THAT AERIAL ARTS TRAINING IS APPROPRIATE FOR THE UNDERSIGNED’S PHYSICAL CONDITION. IF THE PHYSICIAN DISAPPROVES OR APPROVES BUT ONLY SUBJECT TO CERTAIN CONDITIONS, THE SAME SHALL BE COMMUNICATED IN WRITING TO COVENANT NOT TO SUE Aerial Arts Society Inc, their respective founders, board members, officers, directors, instructors, employees, agents, affiliates, collaborators, volunteers, and any other representatives (hereinafter referred to as "Hosts") including non hosts, AS A PRECONDITION TO ENROLLING IN PERFORMANCE, COMPETITION, CLASS, OR TRAINING.

I , THE UNDERSIGNED HEREBY RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE COVENANT NOT TO SUE Aerial Arts Society Inc, their respective founders, board members, officers, directors, instructors, employees, agents, affiliates, collaborators, volunteers, and any other representatives (hereinafter referred to as "Hosts") including non hosts, from all liability to the undersigned for any loss or damage, and any claim or demands on account of injury to the person or property or resulting in death of the undersigned, whether caused by the negligence, pre-existing medical condition, or physical overexertion of the undersigned or otherwise, while the undersigned is in, upon or about the Event Venue or any facilities or equipment. This includes, without limitation, injuries or damages which may result from physical contact with participants or instructors, slipping or tripping and falling due to a dangerous condition of the property, improper maintenance of the Event Venue or equipment, inadequate security, inadequate supervision, and/or improper or negligent instruction. The undersigned, for good and valuable consideration (value), the receipt and sufficiency of which is hereby conclusively acknowledged, including but not limited to being permitted to enter an event venue holding a performance or competition sanctioned by Aerial Arts Society, or any other location (the “Event Venue”) for any purpose, including but not limited to observation, use of facilities or equipment, or participation in any way—such as training, performing, volunteering, judging, and/or competing in pole dance, lyra, silks, or any other apparatus provided by or to the collective (collectively, “Aerial Arts Society” which are both engaged in potentially hazardous activities), I, for myself, my heirs, personal representatives, or assigns, do hereby RELEASE, WAIVE, DISCHARGE, and COVENANT NOT TO SUE COVENANT NOT TO SUE Aerial Arts Society Inc, their respective founders, board members, officers, directors, instructors, employees, agents, affiliates, collaborators, volunteers, and any other representatives (hereinafter referred to as "Hosts") including non hosts, from liability for any and all claims, including negligence of the Hosts resulting in personal injury, accidents, illnesses (including death), and property loss arising from, but not limited to, participation in the event. In further consideration of being permitted to enter the Event Venue for any purpose, including but not limited to observation, use of facilities or equipment, or participation in any way, including in the Aerial Arts, the undersigned hereby agrees to the following: INDEMNIFICATION AND ASSUMPTION OF RISK THE UNDERSIGNED HEREBY AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS THE RELEASEES (Aerial Arts Society) from any loss, liability, damage, or cost they may incur due to the presence of the undersigned in, upon, or about the Event Venue or in any way observing or using any facilities or equipment at the Event Venue, whether caused by the negligence of the Releasees or otherwise. THE UNDERSIGNED HEREBY ASSUMES FULL RESPONSIBILITY FOR AND RISK OF BODILY INJURY, death, or property damage due to the negligence of the Releasees while in, upon, or about the Event Venue or while using the Event Venue or any facilities or equipment therein. THE UNDERSIGNED FURTHER EXPRESSLY AGREES THAT THE FOREGOING RELEASE, WAIVER AND INDEMNITY AGREEMENT AND AGREEMENT TO ASSUME RISK OF POTENTIALLY HAZARDOUS ACTIVITY IS INTENDED TO BE AS BROAD AND INCLUSIVE AS IS PERMITTED BY THE LAW OF THE STATE OF CALIFORNIA, and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

CONSENT AND AGREEMENT TO TERMS The undersigned has read and voluntarily signs this Release and Waiver of Liability, Indemnity Agreement, and Assumption of Risk of Potentially Hazardous Activity, and further agrees that no oral representations, statements, or inducements apart from the foregoing written agreement have been made. Furthermore, the undersigned understands that no one at the Event Venue is authorized to modify this agreement. I fully understand that if any medical treatment is provided to me at the Event Venue, with or without my consent, such treatment will be limited to basic first aid. I hereby waive any and all claims or causes of action arising from or based upon the provision of such treatment, including claims based upon the negligent provision of such treatment. By participating in or attending any activity in connection with Aerial Arts Society, whether inside or outside the Event Venue, I consent to the use of any photographs, pictures, film, or videotape taken of me or provided by me for publicity, promotion, television, or any other use. I expressly waive any right of privacy, compensation, copyright, or other ownership rights connected to such materials by Aerial Arts Society Inc. and Vimala Faith Photography. ENTIRE AGREEMENT AND MODIFICATION No amendment, modification, or supplement to this Agreement shall be binding unless it is in writing and signed by the parties. This Agreement constitutes the entire agreement between the parties and supersedes all previous agreements. If any term or provision of this Agreement is determined to be illegal, unenforceable, or invalid in whole or in part for any reason, such provision shall be stricken from this Agreement and shall not affect the legality, enforceability, or validity of the remainder of the Agreement. Each person signing this Agreement represents and warrants that they are duly authorized and have the legal capacity to execute and deliver this Agreement, including the parents or guardians of any minor. This Agreement shall bind the parents, heirs, executors, and assigns of the undersigned. I HAVE CAREFULLY READ THIS RELEASE. I HAVE NO QUESTIONS TO ASK PRIOR TO SIGNING THIS AGREEMENT. THIS IS A LEGAL DOCUMENT AND I HAVE HAD THE OPPORTUNITY TO CONSULT MY ATTORNEY BEFORE SIGNING IT. I AGREE THAT ANY AMBIGUITY IN THIS AGREEMENT SHALL NOT BE INTERPRETED AGAINST VIMALA FAITH PHOTOGRAPHY OR AGAINST AERIAL ARTS SOCIETY INC., WHO DRAFTED IT. Signing this agreement shall apply to all performances or competitions sanctioned by Aerial Arts Society during the calendar years 2023–2030.

Indemnification and Hold Harmless: I agree to INDEMNIFY AND HOLD HARMLESS COVENANT NOT TO SUE Aerial Arts Society Inc, their respective founders, board members, officers, directors, instructors, employees, agents, affiliates, collaborators, volunteers, and any other representatives (hereinafter referred to as "Hosts") from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including but not limited to attorney’s fees, that arise from or are in any way related to my involvement in The Event (the “Event”), including claims resulting from any accident, injury, illness, or damage to property. I further agree to reimburse the Hosts for any such expenses incurred as a result of any claims made against them. Severability: The undersigned expressly agrees that this indemnification and hold harmless agreement is intended to be as broad and inclusive as permitted by the law of the State of California. If any provision of this agreement is held invalid, the remaining provisions shall continue in full legal force and effect, and the invalid portion shall be modified to the extent necessary to make it enforceable. Acknowledgment of Understanding: I have read this waiver of liability, assumption of risk, and indemnity agreement, fully understand its terms, and acknowledge that by signing, I am giving up substantial legal rights, including my right to sue. I understand and agree that I am voluntarily participating in the Event and intend to release the Hosts from any liability to the greatest extent allowed by law. I assume all risks related to participating in physical activities and consent to such participation, understanding that I am responsible for disclosing any physical limitations, disabilities, ailments, or impairments that may affect my ability to engage in the Event safely.

Photo & Video Consent & Release

By participating in or attending any activity in connection with Aerial Arts Society Inc, their respective founders, board members, officers, directors, instructors, employees, agents, affiliates, collaborators, volunteers, and any other representatives (hereinafter referred to as "Hosts") including non-hosts, such as the photographer and videographer Vimala Faith Photography, whether inside or outside the Event Venue, I hereby consent to the use of any photographs, pictures, film, or videotape taken of me or provided by me for publicity, promotion, television, or any other use, and I expressly waive any right of privacy, compensation, copyright, or other ownership right related to the same. This consent applies to any such media used in connection with the promotion or operation of events, programs, or activities associated with Aerial Arts Society Inc, their respective founders, board members, officers, directors, instructors, employees, agents, affiliates, collaborators, volunteers, and any other representatives (hereinafter referred to as "Hosts") including non-hosts, such as the photographer and videographer Vimala Faith Photography. No amendment, modification, or supplement to this Agreement shall be binding unless it is in writing and signed by both parties. This Agreement represents the entire agreement between the parties and supersedes all previous agreements regarding the subject matter hereof. If any term or provision of this Agreement is determined to be illegal, unenforceable, or invalid in whole or in part for any reason, such provisions shall be stricken from this Agreement, and such stricken provisions shall not affect the legality, enforceability, or validity of the remainder of the Agreement. Signing this Agreement shall apply to the events hosted and sanctioned by Aerial Arts Society Inc, their respective founders, board members, officers, directors, instructors, employees, agents, affiliates, collaborators, volunteers, and any other representatives (hereinafter referred to as "Hosts") including non-hosts, such as the photographer and videographer Vimala Faith Photography for events between 2023 and 2030.
